Waste Management Licensing: A codification
Following a number of amendments to the waste management licensing exemptions, the Scottish Executive issued a consultation on proposals to codify the exemptions (under Schedule 3 of the 1994 regulations) into a revised and concise document.
SESA welcomed the codification proposals as this should improve both SEPA’s approach to the regulation of exemptions and increase operators’ awareness and confidence in the exemption process.
SESA welcomed the opportunity to comment more widely on proposed changes to the waste management licensing regime in Scotland. In its response, SESA pressed for a risk-based approach to licensing and regulation as a means of aligning the administrative burdens with the environmental risk posed by an activity. SESA also called for simplification to the “fit and proper test” to account for changes within the industry towards large multi-national companies in which competence should also account for an operator’s corporate competence.
